Arbitration and mediation are the two main types of alternative dispute resolution (ADR). However, they are quite different in methodology and result. In arbitration, a neutral third party (arbitrator) who is appointed under Arbitration Act to determines the issues and outcome of the case. Arbitration is initiated generally when the parties’ contract mandates arbitration in resolving disputes or alternatively the parties may voluntarily choose arbitration over litigation to benefit from the advantages of arbitration. The arbitrator’s decision is final and binding on the parties by law.
In mediation, a neutral mediator evaluates the issues with the parties and tries to facilitate a settlement agreement that is mutually acceptable. Unlike an arbitrator, a mediator does not render a decision the case. Mediation, as used in law, is a form of alternative dispute resolution (ADR), a way of resolving disputes between two or more parties with concrete effects. Typically, a third party, the mediator assists the parties to negotiate a settlement. Disputants may mediate disputes in a variety of domains, such as commercial, legal, diplomatic, workplace, community and family matters in a less time which may be days or even in hours.
