Husband’s Second Marriage without previous wife permission
According to Islam husband has right to contract four marriage at the same. Islam gives the permission of polygamy and there is no need of any permission from the previous wife or wives.
But in law under section 6 of Muslim Family Law Ordinance 1961 it is manadatory for the husband that he gets the written permission form his previous wife and then from the Arbitration council then he can contract second marriage otherwise the marriage will not be registered.
For second marriage an application must be written to the arbitration council with the reasons and the Chairman call to the existing wife of the husband and applicant then he will give permission.
If any man who contracts another marriage without the permission of the arbitration council and existing wife he must pay immediately the entire amount of the dower whether prompt or deferred, due to the existing wife or wives which amount if not so paid shall be recoverable as arrears of land revenue and on if he is convicted of contracting second marriage without permission he will be punishable with simple imprisonment which may be extend t one year or with fine which may extend to five thousand rupees or with both.
